The radicalism of human rights resides not just in the idea of equality among individuals, but also in the abolition of status-based distinctions associated with group membership. This project conducts a comparative study of European constitutional laws in force before 1914 to determine whether status-based distinctions were aimed at discriminating against members of certain national, religious or linguistic groups. It then examines how these distinctions were phased out in international instruments after 1945.
